Is CBD Legal?
While Cannabis sativa that contains more than 0.3% THC is still considered a Schedule 1 narcotic on the federal level, the 2018 Agricultural Improvement Act paved the way for cannabis containing THC below that level to be cultivated as industrial hemp.
Because CBD does not produce a “high”, products derived from industrial hemp that contain CBD are legal across a majority of the U.S. However, it is important to know the laws in your area, as CBD is not legal everywhere. In Idaho, Nebraska, and South Dakota, CBD remains an illegal substance.
